An 18-year-old male passenger from Indiana, his name protected, to be known in this case as B.M., was sailing aboard Carnival Cruise Lines' Carnival Valor on April 9, 2010, alleges he was sexually assaulted by a male crew member after he entered a public men's' room aboard the cruise ship.

B.M. who was not old to drink aboard, had been approached by a male crew member who offered to buy him alcoholic drinks. After consuming several drinks, B.M. says he needed to use the restroom to urinate and was followed by the crew member.

While he was urinating, B.M. says the crew member entered and watched B.M. urinate in the urinal, staring at his penis. B.M. says it made him uncomfortable and he asked the crew member if he was gay. B.M. says the crew member replied that he was gay. At that time, B.M. says he told the crew member he was not gay.

B.M. attempted to leave the restroom but the door had been locked by the crew member who was blocking the doorway and then grabbed at and slapped B.M.s buttocks.

B.M. left the restroom and reported the incident to ship's personnel.

Carnival Valor left Miami, Florida around 0800 hours on Sunday, April 4, 2010 for an Eastern Caribbean cruise. The ship called at Grand Cayman, Roatan Bay in Honduras, Belize City and Cozumel, Mexico. On April 9 at the time of the attack, the ship was at sea heading back to Miami, where it was due to arrive at 0800 houirs on Sunday April 11.
